OVERVIEW
Welcome to Ballard Consignment. The terms “we”, “us”, and “our” refer to Ballard Consignment. We operate this website and online store, including all related information, content, features, tools, products, and services (the “Services”), to provide you with a curated shopping experience. Our store is powered by Shopify, which enables us to provide the Services to you.
These Terms of Service (the “Terms”) together with any policies referenced here describe your rights and responsibilities when using the Services. Please read them carefully; they include important information such as warranty disclaimers and limitations of liability.
By visiting, interacting with, or using the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Services.
SECTION 1 – ACCESS AND ACCOUNT
By using the Services, you represent that you are at least the age of majority in your jurisdiction, and you consent to allow any of your minor dependents to use the Services on devices you own or manage. You may be asked to provide information (e.g., email, billing, payment, and shipping details). You warrant that all information you provide is true, current, and complete and that you have the rights to provide it.
You are responsible for maintaining the security of your account credentials and all activity under your account. You may not transfer, sell, assign, or license your account to anyone else.
SECTION 2 – OUR PRODUCTS
We make every effort to present products accurately. However, colors and appearance may vary based on your device and settings. We do not warrant that any product or service will meet your expectations or appear exactly as depicted.
Product descriptions and availability may change without notice. We may discontinue products and may limit quantities to any person, region, or jurisdiction.
SECTION 3 – ORDERS
Your order is an offer to purchase. We may accept or decline any order at our discretion. Payment must be received and processed before acceptance. Please review orders carefully before submitting; we may be unable to accommodate cancellation requests after acceptance. If we do not accept, modify, or cancel an order, we will attempt to notify you at the email, billing address, and/or phone number provided.
Purchases are subject to our Return & Refund Policy. You represent that your purchases are for personal or household use and not for resale or export.
SECTION 4 – PRICES AND BILLING
Prices, discounts, and promotions may change without notice. The price charged is the price in effect at the time of order and will appear in your confirmation email. Unless stated otherwise, prices exclude taxes, shipping, handling, customs, and import charges.
Prices online may differ from prices in our physical stores or on third-party sites. Promotions may be governed by separate terms; if there’s a conflict, promotion terms control.
You agree to provide current, complete, and accurate purchase and account information and to promptly update your details (including email and payment info). You represent and warrant that you are authorized to use any payment method you provide and that all charges will be honored.
SECTION 5 – PICKUP & THIRD-PARTY DELIVERY
Ballard Consignment does not offer in-house delivery services. All purchases must be picked up in-store at the location where the item was purchased.
If you choose to use a third-party delivery or moving service, please note:
- You are fully responsible for coordinating pickup and delivery directly with that service provider.
- Ballard Consignment is not responsible for any damages, delays, or fees incurred once an item leaves our store.
SECTION 6 – INTELLECTUAL PROPERTY
All content and materials on the Services (including trademarks, text, graphics, imagery, video, audio, and their arrangement) are owned by Ballard Consignment or its licensors and are protected by applicable laws. You may use the Services for personal, non-commercial purposes only. Except as expressly permitted, you may not copy, distribute, modify, create derivative works, publicly display, or otherwise use our content without prior written consent.
Ballard Consignment names, logos, and related marks are trademarks of Ballard Consignment. Shopify’s names and marks are trademarks of Shopify. Other marks belong to their respective owners.
SECTION 7 – OPTIONAL TOOLS
We may provide access to third-party tools “as is” and “as available” without warranties or endorsements. Your use is at your own risk and subject to the third party’s terms. New features or tools added in the future are also subject to these Terms.
SECTION 8 – THIRD-PARTY LINKS
The Services may contain links or embedded content provided by third parties. We are not responsible for examining or evaluating such content and assume no liability for your access or use. Review third-party policies before engaging in transactions with them.
SECTION 9 – RELATIONSHIP WITH SHOPIFY
Ballard Consignment is powered by Shopify, which enables us to provide the Services. However, purchases are made directly with Ballard Consignment. Shopify is not responsible for sales between you and Ballard Consignment, including any injury, damage, or loss from purchased products or services. You expressly release Shopify and its affiliates from claims arising from your transactions with Ballard Consignment.
SECTION 10 – PRIVACY POLICY
Personal information collected through the Services is subject to our Privacy Policy. Certain personal information may also be processed by Shopify under Shopify’s privacy policy. Because the Services are hosted by Shopify, information you submit will be transmitted to Shopify and service providers (which may be located outside your country). Please review our Privacy Policy for details.
SECTION 11 – FEEDBACK
If you submit reviews, ideas, or other content (“Feedback”), you grant us a perpetual, worldwide, sublicensable, royalty-free license to use, reproduce, modify, publish, and display such Feedback for any purpose. You represent that you own or have rights to the Feedback and that it complies with these Terms. We may monitor, edit, or remove Feedback in our discretion.
SECTION 12 – ERRORS, INACCURACIES & OMISSIONS
Information on the Services may occasionally contain typographical errors or inaccuracies (e.g., descriptions, pricing, promotions, shipping charges, transit times, availability). We reserve the right to correct, update, or cancel orders if information is inaccurate, without prior notice (including after order submission).
SECTION 13 – PROHIBITED USES
You may use the Services only for lawful purposes. You agree not to, among other things: violate laws; infringe intellectual property; harass or harm others; send spam; impersonate others; upload malware; scrape or collect personal information; reproduce or exploit the Services; or interfere with security features. We may suspend or terminate access for violations.
SECTION 14 – TERMINATION
We may terminate or suspend the Services or your access at any time, in our discretion, without notice. You remain liable for amounts due up to the termination date. Sections that by nature should survive (including Intellectual Property, Feedback, Disclaimers, Limitations, Indemnification, Severability, Waiver/Entire Agreement, Assignment, Governing Law, and Privacy) will survive.
SECTION 15 – DISCLAIMER OF WARRANTIES
Except as expressly stated by Ballard Consignment, the Services and all products are provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant uninterrupted, timely, secure, or error-free operation. Some jurisdictions do not allow certain disclaimers; in those places, the disclaimer applies to the maximum extent permitted.
SECTION 16 – LIMITATION OF LIABILITY
To the fullest extent permitted by law, Ballard Consignment and our partners, officers, employees, agents, contractors, service providers, licensors, and Shopify and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, savings, data, or replacement costs, arising from or related to your use of the Services or products, even if advised of the possibility.
SECTION 17 – INDEMNIFICATION
You agree to indemnify and hold harmless Ballard Consignment, Shopify, and our respective affiliates, officers, employees, agents, contractors, licensors, and service providers from claims and expenses (including reasonable attorneys’ fees) arising out of your breach of these Terms, violation of law or third-party rights, or use of the Services.
SECTION 18 – SEVERABILITY
If any provision of these Terms is found unlawful or unenforceable, it will be enforced to the maximum extent possible, and the remainder will remain in effect.
SECTION 19 – WAIVER; ENTIRE AGREEMENT
Our failure to enforce any right or provision is not a waiver. These Terms and policies posted on the site constitute the entire agreement between you and us and supersede prior agreements. Any ambiguities will not be construed against the drafting party.
SECTION 20 – ASSIGNMENT
You may not assign or transfer these Terms without our prior written consent. We may assign or transfer these Terms without notice.
SECTION 21 – GOVERNING LAW
These Terms and any separate agreements for the Services are governed by the laws of the State of Washington, without regard to conflicts of law. You consent to venue and personal jurisdiction in state or federal courts located in Washington.

Headings are for convenience only and do not limit these Terms.

You can review the most current version of the Terms on this page. We may update or change these Terms by posting updates to our website. We will notify you of material changes as required by law. Your continued use of the Services after changes are posted constitutes acceptance.
